These Terms and Conditions set out the basis on which Waste Disposal Canary Wharf provides waste collection and disposal services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions, which form a contract between you and Waste Disposal Canary Wharf for the supply of services in the United Kingdom.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Customer means the individual, business, landlord, property manager, agent or organisation that requests or receives the services.
1.2 Services means waste collection, rubbish removal, bulky item clearance, recycling, and any associated activities carried out by Waste Disposal Canary Wharf as agreed with the customer.
1.3 Booking means a confirmed request for services made by the customer and accepted by Waste Disposal Canary Wharf.
1.4 Site means the address or location at which the services are to be provided.
1.5 Waste means the materials, rubbish or items to be collected from the site, excluding materials that are prohibited under these Terms and Conditions or under applicable regulations.
2.1 Waste Disposal Canary Wharf provides waste collection and disposal services within Canary Wharf and surrounding areas, subject to availability and operational capacity.
2.2 The exact services to be provided, including type of waste, volume, estimated weight, timing and access requirements, will be agreed at the time of booking based on the information supplied by the customer.
2.3 The company reserves the right to decline any booking where the waste type, volume, access conditions or regulatory requirements make the service unsafe, unlawful or impracticable.
2.4 Services are provided for lawful waste only and must comply with applicable waste management and environmental legislation in the United Kingdom.
3.1 Bookings may be made by telephone, email or through the companys online enquiry or booking systems, where available.
3.2 When making a booking, the customer must provide accurate and complete information, including:
(a) Full name, company name where applicable, and contact details.
(b) Exact collection address and any access restrictions.
(c) Description of the waste, including type, approximate quantity and any hazardous characteristics.
(d) Preferred date and time window for collection.
3.3 A booking is only confirmed when Waste Disposal Canary Wharf has issued a booking confirmation to the customer by email, text message or other agreed communication method.
3.4 The company may request photographs or additional information about the waste and site access before confirming the booking.
3.5 The customer acknowledges that any quotation provided prior to the collection is based on the information supplied and is subject to change if the actual waste or site conditions differ materially from the description given at the time of booking.
4.1 Prices are usually based on estimated volume, weight, type of waste, labour time, distance and any specific access or disposal requirements.
4.2 Any quotation provided before collection is an estimate only. The final price will be confirmed on site once the team has assessed the waste and conditions.
4.3 If the quantity or type of waste exceeds that stated at the time of booking, or if access is more difficult than described, the company may:
(a) Revise the quotation and seek the customers approval before proceeding; or
(b) Decline to proceed with all or part of the service where it is not reasonably practicable or safe.
4.4 All prices are quoted in pounds sterling and may be subject to VAT and other applicable charges where required by law. The customer will be informed where VAT applies.
5.1 Payment terms will be confirmed at the time of booking. For most domestic customers, payment is due on completion of the collection or in advance, as specified.
5.2 Accepted payment methods may include cash, card payments, bank transfer or other methods notified to the customer. The company reserves the right to refuse certain payment methods for security or operational reasons.
5.3 For business customers with agreed credit terms, payment must be made in full within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.
5.4 If the customer fails to pay any amount due on time, the company reserves the right to charge interest on the overdue sum at the statutory rate permitted under UK law, as well as any reasonable costs incurred in recovering the debt.
5.5 Title to any waste collected passes to the company only after payment has been received in full, subject to compliance with all relevant regulations.
6.1 The customer may cancel or amend a booking by providing notice to the company by telephone or email.
6.2 Where the customer cancels a booking more than 24 hours before the agreed collection time, no cancellation fee will usually be charged, unless specific arrangements or third-party costs have already been incurred.
6.3 Where the customer cancels a booking less than 24 hours before the agreed time, the company reserves the right to apply a cancellation charge to cover administrative, labour and scheduling costs.
6.4 If the team attends the site at the agreed time and is unable to carry out the service due to reasons within the customers control, including but not limited to lack of access, unsafe conditions or unavailability of the waste, a call-out or wasted journey fee may be charged.
6.5 The company may cancel or reschedule a booking where it is unable to perform the service due to circumstances beyond its reasonable control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness or regulatory restrictions. In such cases, the company will endeavour to notify the customer as soon as reasonably practicable and arrange an alternative time.
7.1 The customer must ensure that:
(a) The site is safe and accessible for the collection team and vehicle, including any parking or loading requirements.
(b) Any necessary permissions, permits or consents for access, parking or loading are obtained in advance.
(c) Waste is presented in a manner that is safe to handle, without risk of injury or contamination.
7.2 The customer must declare any hazardous, clinical, electrical, chemical or restricted waste in advance so that appropriate handling and disposal arrangements can be made, if the company is able to accept such waste.
7.3 The customer is responsible for ensuring that waste is not mixed with prohibited materials, including but not limited to asbestos, certain chemicals, explosives, flammable materials, gas cylinders and other restricted substances.
7.4 The customer must ensure that any personal data or confidential material within the waste is removed or destroyed before collection. The company is not responsible for any loss, disclosure or misuse of personal or confidential information left in the waste.
8.1 Waste Disposal Canary Wharf operates in accordance with relevant UK environmental and waste management legislation. The company will transport and dispose of collected waste only at authorised facilities and through properly licensed channels.
8.2 For commercial customers, a waste transfer note or other required documentation may be provided, setting out the type and quantity of waste and confirming its lawful transfer.
8.3 The customer must cooperate with any reasonable request for information necessary to comply with waste transfer and environmental reporting obligations.
8.4 The company reserves the right to refuse to collect any waste that appears to be unlawful, improperly described, contaminated or hazardous in a way that has not been previously declared.
8.5 The customer must not request the disposal of waste in a manner that breaches environmental regulations. The company will not participate in fly-tipping, unlicensed dumping or any other unlawful disposal activity.
9.1 Waste Disposal Canary Wharf will exercise reasonable skill and care in providing the services. However, the companys liability is subject to the limitations set out in this section.
9.2 The company will not be liable for any loss, damage, cost or expense arising from:
(a) Inaccurate, incomplete or misleading information provided by the customer.
(b) Failure by the customer to comply with these Terms and Conditions.
(c) Pre-existing defects or weaknesses in the site, property, access routes or vehicles provided by the customer.
9.3 While reasonable care will be taken when removing waste from the site, the customer must inform the team of any fragile surfaces, fixtures, flooring, stairways or other areas that require special attention. The company will not be liable for minor cosmetic damage or wear and tear reasonably associated with the normal performance of the services.
9.4 If the company is found liable for damage to property or possessions caused by negligence, its total liability will be limited to the reasonable cost of repair or replacement, taking into account depreciation and fair wear and tear, and subject to any applicable insurance limits.
9.5 The company will not be liable for any loss of profit, loss of business, loss of contracts, loss of data, consequential loss or indirect loss suffered by the customer.
9.6 Nothing in these Terms and Conditions shall limit or exclude the companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
10.1 The customer is responsible for ensuring suitable access for the collection vehicle and team at the agreed time. This includes arranging keys, entry codes or the presence of an authorised person on site.
10.2 The customer must inform the company of any parking restrictions, height limits, loading bay rules, road closures or other conditions that could affect the service.
10.3 Where parking or suspension permits are required, the customer is generally responsible for obtaining them in advance. If the company agrees to arrange permits on the customers behalf, the related costs will be added to the service charge.
10.4 If the team is unable to park or access the site due to inadequate arrangements, the company may apply additional waiting time charges, reduced service, or a wasted journey fee.
11.1 While every effort is made to attend at the agreed time, all arrival times are estimates and may be affected by traffic, weather, operational issues or other factors beyond the companys control.
11.2 The company will not be liable for any delay or failure to perform the services where such delay or failure results from events beyond its reasonable control, including but not limited to adverse weather, accidents, road closures, breakdowns, strikes, industrial disputes, acts of government, or other force majeure events.
12.1 If the customer is dissatisfied with any aspect of the service, they should notify the company as soon as possible, ideally within 48 hours of the collection, providing details of the issue and any supporting information.
12.2 The company will investigate complaints in a timely manner and, where appropriate, may offer a remedy such as re-attending the site, providing additional documentation, or adjusting charges in line with its policies and obligations.
13.1 The company will handle personal data provided by the customer in accordance with applicable UK data protection laws.
13.2 The customer consents to the use of their contact details for the purpose of administering the booking, providing the services, issuing invoices and communicating about the account.
13.3 The company may retain records of bookings and waste transfer documentation for legal, regulatory and audit purposes.
14.1 Waste Disposal Canary Wharf may amend these Terms and Conditions from time to time. Updated terms will take effect from the date they are published or otherwise communicated to customers.
14.2 The terms in force at the time of your booking will apply to that particular service, unless changes are required by law or regulatory authority.
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the services.
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be treated as deleted, and the remaining provisions shall continue in full force and effect.
16.2 No failure or delay by the company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy.
16.3 These Terms and Conditions, together with any written quotation or confirmed booking details, constitute the entire agreement between the customer and Waste Disposal Canary Wharf in relation to the services and supersede any prior discussions or agreements.
16.4 The customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the company.
16.5 Nothing in these Terms and Conditions is intended to confer any right or benefit on any third party, and no third party shall have any rights to enforce any of these terms under the Contracts (Rights of Third Parties) Act 1999.
